ArcelorMittal Dofasco gets "free pass" on pollution: Environment Hamilton

Environment Hamilton says ArcelorMittal Dofasco has been given a "free pass" on pollution infractions until 2019 by the Ministry of Environment.

It has released an email trail with the ministry where it says they do not intend to pursue further investigation into the coke plant "that may or may not result in charges, " during the period the company has promised to fix the problems.

The plant was fined $390,000 in May 2013, stemming from charges a year earlier, and has committed to $87 million in upgrades on a five-year plan, set to be completed in 2019. That response appears to satisfy the Ontario Ministry of the Environment, according to an email exchange between ministry spokesperson Jennifer Hall, and Environment Hamilton executive director Lynda Lukasik.

Asking if the ministry would investigate any further infractions by ArcelorMittal Dofasco, after the 13 infractions from 2012 that resulted in the record fine, the ministry gave an emphatic no. 

"The guilty plea resolves these matters," Hall wrote in a single-line email on June 9, 2014, provided by Environment Hamilton. 

"Rather than pursuing further investigations that may or may not result in charges," Hall stated in another email to Lukasik the same day, "the ministry believes the best way to control emissions from Arcelor(Mittal Dofasco) is to require the company to take action now, improve its operations and invest in new technology to reduce emissions."

Lukasik called the agreement with the province a done deal, as well as a "sweetheart deal," considering the five-year timeline for the improvements.
