After years in limbo and 20 postponements, a hearing date has finally been set for a Hamilton police officer accused of sending an "unprofessional" email to his colleagues.
Sgt. Robert Mayea's police act hearing has been pushed back because he is suffering from PTSD, he says, but evidence in the case will begin to be heard in September, officials decided during a conference call Tuesday.
"This matter needs to be resolved and this tribunal has been extremely patient," Superintendent Mike Shea said on the call.
Mayea is facing Ontario Police Act charges for violating code of conduct and corporate email policies from an email he sent back in 2011.
The contents of that email haven't been revealed publicly – but in a previous interview with CBC Hamilton, Mayea said it was a "tersely worded" complaint about harassment and bullying from higher-ranking officers with the Hamilton service.
'My opinion is he has actually gotten worse and not any better.'- Brad Boyce, defence counsel
"I'm suffering, and my family is suffering," he saidin that interview. "The PTSD has been insurmountable to date." The veteran officer spent years working primarily on child abuse and sudden death cases.
The hearing was last delayed while police officials waited for word from Mayea's doctor on his condition. Hearing officer Shea said he received word from the doctor at the end of January. "The doctor's opinion is Sgt. Mayea is not in a position to proceed with a hearing at this time because it would be detrimental to his health," Shea said.
Mayea himself wasn't on the call, but his legal counsel Brad Boyce said in his "unprofessional" medical opinion, Mayea's condition has deteriorated. "My opinion is he has actually gotten worse and not any better," Boyce said.
Hearing officials said during the call that they set a date far enough in the future for Mayea to continue to seek treatment.
Prosecutor Marco Visentini has not filed papers seeking demotion or dismissal, which means it's a hearing that could be dealt with "relatively easily," Shea said.
Boyce and Meyea have said that he is not being paid, but won't elaborate as to why he isn't working.
