Son charged with manslaughter, neglect after his mother dies

An 82-year-old Hamilton woman is dead and police have charged her son with manslaughter and failing to provide the necessities of life.

The Hamilton police crimes against seniors unit launched an investigation back in January after an elderly woman was admitted to hospital with "several serious medical concerns and signs of neglect," according to a police news release.

The woman's 57-year-old son was charged with failing to provide the necessities of life and is still in custody, police say.

On Feb. 23, the victim succumbed to her injuries and died in hospital. After consulting with the coroner's office, medical staff at the hospital and the crown attorney, police laid a manslaughter charge against the man in relation to his mother's death.

All Det. Sgt. Matt Kavanagh would say about the woman's injuries was that they "occurred over a period of time, and they were extremely serious."

Regional coroner Jack Stanborough told CBC Hamilton that he couldn't release investigative findings related to the case until the court case is dealt with.

"The description of the body will come out in court," he said. A Hamilton Health Sciences representative would not reveal the extent of the woman's injuries, citing confidentiality issues.

A charge of criminal negligence causing death is more common in an instance like this than manslaughter — but police chose to to move forward with a manslaughter charge because it carries more weight and the penalties if found guilty are more severe, Kavanagh says.

"That's why we did it," Kavanagh said. "It speaks to the injuries in this case."
